1. Acceptance of Terms
By accessing or using 1Minute AI ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users including store owners, administrators, and end customers interacting with deployed chatbots.
2. Description of Service
1Minute AI provides an AI-powered chatbot platform that allows website and e-commerce store owners to deploy trained AI assistants on their websites. The Service includes website crawling, AI model training, chat widget embedding, Shopify store integration, and an analytics dashboard.
3. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must notify us immediately of any unauthorized use of your account.
- One account per organization. Multi-user access is managed via organization settings.
4. Subscription and Billing
- 1Minute offers Free, Starter ($29/mo), Pro ($79/mo), and Scale ($199/mo) plans.
- Subscriptions are billed monthly in advance via PayU.
- Conversation limits reset at the start of each billing cycle.
- Upgrading takes effect immediately. Downgrading takes effect at the next billing cycle.
- We reserve the right to change pricing with 30 days notice.
5. Acceptable Use
- You may not use the Service for illegal, harmful, or fraudulent purposes.
- You may not use the Service to deploy chatbots that deceive, harass, or harm users.
- You may not attempt to reverse engineer, scrape, or exploit the Service's infrastructure.
- You may not resell or sublicense access to the Service without written permission.
- Violation of these terms may result in immediate account suspension.
6. Shopify Integration and Data Processing Addendum
- This section applies to merchants who connect their Shopify store to 1Minute AI and serves as a Data Processing Addendum (DPA) between the merchant (data controller) and 1Minute AI (data processor) for the purposes of applicable data protection laws including GDPR and India's Digital Personal Data Protection Act.
- Roles: the merchant is the data controller for their customers' personal data. 1Minute AI acts as a data processor, processing personal data solely on the merchant's documented instructions as defined by these Terms and the merchant's use of the Service.
- Scope of processing: 1Minute AI processes customer personal data (name, phone number, shipping address, order details) accessed via the Shopify Admin API solely to enable chatbot responses to shopper queries on the merchant's storefront.
- Data minimization: we process only the personal data necessary to answer shopper queries, fetched per-query in real-time. We do not bulk-sync or maintain a separate copy of the merchant's customer database.
- Sub-processors: we use the following sub-processors, each bound by appropriate data protection obligations: Convex (database), Vercel (hosting), AWS (infrastructure and secrets management), Clerk (authentication), Groq and Google Gemini (AI inference), Firecrawl (web crawling). A current list is maintained in our Privacy Policy.
- Security measures: we implement technical and organizational measures including TLS 1.2+ encryption in transit, encryption at rest, tenant isolation, access logging, least-privilege access controls, and secure credential storage via AWS Secrets Manager.
- Data subject rights: we assist merchants in responding to customer requests for access, correction, deletion, and portability. We honor Shopify's mandatory GDPR compliance webhooks (customers/data_request, customers/redact, shop/redact).
- Data breach notification: in the event of a personal data breach affecting merchant data, we will notify the affected merchant without undue delay and in any case within 72 hours of becoming aware of the breach.
- Data deletion on termination: upon app uninstall or account termination, merchant and customer personal data is deleted within 48 hours, as processed through Shopify's shop/redact webhook. Conversation transcripts are retained per the retention policy in our Privacy Policy.
- International transfers: where personal data is transferred outside the merchant's jurisdiction, appropriate safeguards are applied consistent with applicable law.
7. Intellectual Property
1Minute AI and its original content, features, and functionality are owned by 1Minute and are protected by applicable intellectual property laws. Your data and content remain your property. You grant 1Minute a limited license to process your data solely to provide the Service.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.
9. Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted availability. Scheduled maintenance will be communicated in advance where possible. We are not liable for losses caused by service downtime or interruptions.
10. Limitation of Liability
To the maximum extent permitted by law, 1Minute AI shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the 3 months preceding the claim.
11. Termination
You may cancel your account at any time from your dashboard settings. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your data will be retained for 30 days before permanent deletion. For Shopify merchants, data is additionally deleted within 48 hours of app uninstall per Shopify's shop/redact webhook.
12. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka, India.
13. Changes to Terms
We may revise these Terms at any time. We will notify you via email for material changes. Continued use of the Service after changes constitutes acceptance.
